Mazda Class Action Alleges Carmaker Knew About Water Pump Defect - Top Class Actions

2022-10-09 15:54:04 By : Mr. Kevin Zhang

A group of 20 Mazda drivers filed a hefty class action lawsuit against the carmaker for a water pump defect that they say can lead to “catastrophic engine failure… at any time without prior warning.” The defect has caused one fatal accident already.

The water pump defect occurs in the MZI Cyclone engine in the CX-9 for model years 2008 through 2015 and the Mazda6 for model years 2009 through 2013.

The plaintiffs seek to represent a nationwide class of all persons or entities in the United States who purchased, leased or own a class vehicle. There are 12 state-specific subclasses for California, Florida, Illinois, Louisiana, Massachusetts, Michigan, Missouri, North Carolina, Ohio, Pennsylvania, Texas and Virginia. There are also two subclasses related to specific California state laws.

The defect detailed by the complaint involves the internal chain-driven water pump. The pump is meant to circulate coolant through the engine while the engine is running. However, the defect in question allows coolant to leak from the water pump into the oil pan and/or other engine components, mixing it with the engine’s oil and leading to destruction of the engine.

The water pump is located deep within the engine behind several other components and would cost more than $1,500 to repair or replace, according to the complaint.

Plaintiffs argue that they and the class were not told about the potential defect. However, Mazda’s internal data indicates that the company began receiving reports of water pump failures in class vehicles by at least June 2007, according to court documents. Mazda received at least 58 warranty claims for failed water pump failures in 2009. Complaints were also made to the National Highway Traffic Safety Administration.

The plaintiffs seek class certification and approval of class counsel, declaratory relief, an order preventing Mazda and other defendants from continuing their allegedly unlawful behavior, injunctive and equitable relief, damages, statutory and civil penalties, pre- and post-judgment interest and attorneys’ fees.

The plaintiffs are represented by Joseph H. Meltzer, Melissa L. Troutner, Tyler S. Graden and Natalie Lesser of Kessler Topaz Meltzer & Check, LLP et al.

The Mazda Water Pump Defect Class Action Lawsuit is Sonneveldt et al. v. Mazda Motor of America Inc. et al. , Case No. 8:19-cv-01298, in the U.S. District Court for the Central District of California.

Can we still join the suit? Mine did exactly what all of yours did last week. Will cost over 10k to replace the engine and another 4k for a new water pump. 2015, Mazda CX9

Mazda CX-9 2013 same issue, vehicle hesitated, vibrated, white smoke out of exhaust then shut down.

Same here….2016 CX9 Grand Touring engine just went out. No warning lights or anything and now the dealer wants close to $11k to replace it with a 1 year warranty on the replacement. What a joke!

Wisconsin / 2014 model – 86,000ish miles. Service engine light went on. Took it in and dealership cleared the code. The next day the water pump went out and killed the engine based on this horrible design. We had the dealership total the car and cut our losses. Service tech wouldn’t acknowledge, but said it’s happening a lot.

2013 bought in 2021 with 75000 miles no warranty. Same here. Have 2 years of payments left so opted for new engine and hoping for best

Virginia | 2014 CX-9 Touring purchased new in 2015 | 80K miles. Replaced engine for $10K.

Mine too. 94,000 miles. One month after taking it in for service(at the dealership), I was assured that everything was fine. The engine started running really loud. Realized all the antifreeze was gone. Took it back to the dealership only to be told the water pump failed and it would cost over 9,000 to fix it.

2013 Mazda CX-9 Mechanic diagnosis engine failure. Have not repaired yet, sitting in my garage refuse to pay high quoted amount.

Me too! My car has been sitting in my garage since February 2020 and still paying it off. :(

My 09 is on it’s 3rd motor for this reason.

Was the 2015 Mazda 3 included or the 2005azda3 included in this lawsuit? Thanks

Ditto. 2014 CX-9 Touring. Got Check engine code P0013. Dealer called it the “code of death” for this car. Telltale sign was to check the oil. If it’s milky and bluish (from the coolant), the coolant has gotten into the oil and causes rapid engine failure. Will cost about $9500 to replace engine.

2014 Mazda CX-9, 92,000 miles on it. Water leaking out the bottom, over heating. Parked it in the driveway all the coolant leaked out. Can’t drive it called the dealership they said it is a Mazda water pump issue. Might have to replace the engine as well. So it will sit for now…. Mazda needs to make good on these B.S. Ford engines they put in. They know about it and still screw the people over for profit, sorry A$$ Rat Pricks……

How can we join the lawsuit? 2015 CX-9 is literally in the shop right now because this happened to us. My daughter was driving when it died while in motion. I dread thinking about what could have happened. It is now receiving a new motor costing us $10,000!!

Call Mazda Corporate and file a claim immediately. I have an open case with them.

Do you have a phone number?

Happened to us too 😩 cost $8000 to get it fixed. Located in Utah. Sign us up!

Add me to the list. My 2010 Cx-9 Grand Touring did the same thing yesterday on the interstate. Loaded down with 3 young children, car died in the middle of rush hour. No one stopped to help. Drivers were getting so angry cause we were blocking traffic. So many times we were almost hit. No warning at all. Literally died within 5 min of noticing a problem. I have kept this car in mint condition. Single mom of 3. This has been catastrophic for us. Shame on Mazda.

I have 2014 cx9 with 116k with the water pump problem too

Well.. Sign me up too I suppose. 2015 cx-9 touring. Chocolate milk in the oil. Have parked it to wait and see what happens.

2012 Mazda CX-9, I too had a catastrophic Water Pump failure, Mazda denies any problems regarding the water pump. Also Mazda Service refuses to accept vehicle for repair as they claim they can’t get the parts and I would need to wait at least 5 weeks before I could even get an appointment! 63,000 miles. I would like to join the Class Action Lawsuit.

2014 CX-9 119K – water pump failure. Local Mazda dealer says $5,550 – $6K to repair. I had it towed to dealer when the check engine light came on. Local dealer said they are familiar with this common problem and that Mazda USA is not helping. I filed a case with them and after 3 weeks was informed that Mazda will not assist with the repair.

We are dealing with the same exact thing right now! Except we brought ours in 2 months before for fluid leaking they said It was a lose line and tightened it and here we are two months later needing a completely new engine and transmission. 15,000 is what we were told it would be for for parts and labor. Mazda refuses to do anything!

I have a 2014 Mazda and my water pump went out

2014 Mazda CX-9 -102,500 miles – Only serviced by dealer Water Pump failed without notice – Just started making a crazy clicking noise Now at dealer for repairs taking over a month & @ a $6500 bill for parts/labor

Dealer started repairs then found out engine had been compromised with metal though out the engine – Now needs a new engine – $12,000 and a 6 month wait for a replacement engine CRAZY !!!

We just experienced same issue. The local dealer who is the only mechanic who serviced it was clueless. The vehicle was a 2014 CX 9 with 87000. We had vehicle serviced when recommended without fail only by dealer. I will never buy another Mazda again as they could care less.

This just happened to my family and I. 2012 Mazda CX-9.

We are experiencing this right now! We are hundreds of miles from home when 2014 cx9 shut off. Coolant in oil. 400$ tow plus hotel and rental car!

Yep mine went out back in 2009. Been sitting in front of my house since then. Mazda said it would be $11,000 to replace.

Same thing here for my 2013 Cx-9 at 110k miles. Always maintained at the dealer yet no one there ever thought to mention the problem or suggested a replacement within or even outside of the extended warranty to avoid the catastrophic failure. Please contact if lawsuit is still open.

mine too. at 108k. I just had my water pump replaced. The thing is there was no warning about the water leakage. very dangerous. I want to join the lawsuit as well.

I also have had my 2008 CX-9 water pump issue and I’ve talked to some other lawyer already but if I can get a response back that would be great I was thinking about selling a car but I don’t want to sell it if we get this lawsuit going

Mine went out today, with 108,000 miles.

I really hope the court recognizes that this is a serious issue.

An engine should not have to be replaced just outside of warranty.

If potential owners knew of this major issue, the value of CX9 would be less than half of what it should have been sold. The price of the car, new or used, priced in much longer use of the engine than 40k, 60k, or even 100k miles.

Right mine went up at 76,000 just last my extended warranty! We need to do something about this!

This happen to me this past Monday, May 30 on Memorial Day as I was driving on a busy highway in PA. I was going about 65 mph and without any warning the RPMs went from 4000 to 0, followed by the check engine light. Luckily I was still coasting in the right lane and able to get over to the shoulder before car stopped. Had to get it towed home which cost me $500 and my wife/kids an uber ride for another $120. Then towed to the dealership where mechanic provided me with the same conclusion as what is in the class action suit and would need new engine. Now I have to hope the extended warranty is adhered to as I have one to 100k miles (but I have no faith the right thing will be done). I bought a certified 2014 CX-9 when it had 44K miles on it and now only has 76K miles.

Same thing happened almost exactly. Unfortunately for us, no extended warranty.

But then even if you replace the engine, you are still riding on an engine with a flawed design that is a ticking time bomb.

Mazda CX9 2010, 104k miles, started hearing a weird noise from engine side, checked it with local mechanic, he found the engine water pump issue and it may cost $2000 to fix it.

This happened to me a year after I bought my Mazda CX-9. Luckily I had an extended warranty. They replaced the engine with a short board engine bc they didn’t have any regular ones. I have had breathing problems every since then and have to wonder if something happened when engine failed. I’ll never buy a Mazda again.

Mazda is great! ford designed that engine so ford is to blame

2014 cx-9. Catastrophic failure. $13,000 to fix. Had to purchase a new car. How do we get added to this lawsuit?

Just out that the same thing happened to me we owe 8,000 on my cx9 and now we’re trying to firgure out how we can afford a new motor.

Have the same issue as well

Mazda is great! ford designed that engine so ford is to blame

I’m a victim also. All the coolant drained and no hose leaks. Oil is mixed with coolant. Engine is probably ruined. No lights, no warning.

My 2008 cx9 mazda water pump went out and its and it boiled on my engine this was a expensive repair that I’m not eased with especially when u call the dealer and they tell u there nothing they can do.

The same happened to me. On top of that, the replacement water pump also failed. Mazda CX-9 2013 100k, purchased verified with extended warranty but not a boo from the dealer about the problem before it happened and no help afterwards either.

I own a 2015 cx9 mazda all oil or mechanical work was preformed by mazda ,tire changes even the dent from when we were hit by a car,my wife was on her way to work a few blocks down check engine came on she went back home to trade for different car,we drove it to mazda dealer ship ,she called first they told her to drive it over there witch she did. We heard from them the next day we had water in our oil, ok how did this happen. They explained that the water pump is built in to the motor, I ask they why they didn’t mention this when we were buying the car ,I know that water pumps go out ,some sooner some later but who wants to pay for it to get fixed every 5 to 7 years they wanted 2,800.00 to repair it next the told me that they were draining the oil and there were metal pieces and that I would have to replace the motor. At first they told me verbally that it would cost me 4,800.00 ,we talked back and forth, I then spoke to the manager about my issue he said he would make a deal, they must think I’m stupid ,their deal was that they would erase my debt around 9000.00,I laughed and told them that it was a stupid idea, they painted a pretty picture; they erase my debt, and instead of spending my money on a new motor that I use that money for a down payment ,If i wanted to buy another car it wouldn’t be a mazda The next time they told me that the motor was more like 8 or 9 thousand dollars . One conversation that a mechanic told my wife . ” that what I can do is to put all the fluids back in there place and to sell it and to not tell the buyer that it has a problem, my wife said you want my husband to be dishonest that is what he is thinking about mazda imagine that. I’m not even getting into the cx3 basically same problem except this had no oil in motor when asked Thierry answers was they didn’t know no oil leaks

The same happened to my CX9 Destroyed the Engine.

My cx-9 water pump just went out causing major damage and very expensive to fix

2012 CX9 – 124,000 same thing happened, coolant leaked into engine. I had just left the freeway and picked up my mom, when the car started shaking and stalled out. Luckily, I was still on her street and not back on the freeway! Engine ruined. Sign me up for class action lawsuit.

2014 CX-9, 136k miles, same……water pump went out destroying the engine. All I’ve ever driven in my life are Mazdas (2 Rx7s, 2 Millenias, a 6 and a CX-9). Used to love the brand. Now, not so much. Can’t believe they won’t stand behind their product.

April 23,2022 my Mazda CX 9 Sport with 85,000 miles water pump failed causing coolant to mix in engine. Occurred on a highway and shut off with no warning. Warning lights came on after steering locked up. Luckily my son who was driving managed to avoid an accident. A local mechanic verified the engine needs repair cost used $7k, new $10k estimated. Called 2 Mazda dealers for guidence both claimed not a widespread problem then blamed Ford engine used or poor maitainence. Previously loved Mazda, now since their denials of problems not so much. I previously owned a Mazda truck and currently own a CX5.

Bought 2013 Cx 9 in Dec. 2014 and in 2022 with 104K miles the water pump went out and destroyed the engine. Cost to purchase rebuilt engine was expensive.

2011 here. Water pump and engine rebuild. Had the car for 1 year for my college age daughter 4 hours from home. Devastated to say the least. Can’t afford to fix.

Had my water pump go in my 2014 Mazda CX-9. Where I had my car repaired, the mechanic said it was strange that it went like it did. It was a very costly repair.

Have a 2012 Mazda CX9 has 137473 miles chocolate milk in the oil
